Sub.: TRANSFER/PLACEMENT/DEPUTATION POLICY FOR GROUP "B" GAZETTED AND GROUP "B" NON-GAZETTED OFFICERS POSTED TO GUJARAT CUSTOMS ZONE, AHMEDABAD: M/r.
In order to create an efficient delivery system and proper capacity building, a review of the present system of transfer and posting has been carried out. The present system has failed to give sufficient exposure to officers of the respective zones in the vast field of Central Excise, Service Tax and Customs. The existence of more than one sector within the Zone is resulting in disparity in equal opportunities in terms of exposure and postings as well as giving rise to extremely localized factors causing administrative inconvenience and unbalanced distribution of human resources.
2. Therefore, a meeting was held to discuss and revise transfer/ placement policy Gr. "B" Gazzetted and Gr. "B" Non- Gazzetted executive officers in Ahmedabad Central Excise Zone, Ahmedabad Customs and Vadodara Zone. During deliberations, various changes were proposed. Accordingly, suitable changes have been effected and the proposed . policy has been drafted separately for Ahmedabad and Vadodara Central Excise Zone and Ahmedabad Customs Zone and the same are enclosed herewith. It is requested that the comments /views on the proposed policy may be intimated to this office. It is also brought to your notice that a meeting with Association is to be held on 26.05.2011 at 11.00 AM in the Conference Room, Central Excise Bhavan, Ambawadi, Ahmedabad. PROPOSED TRANSFER/ POSTING/ ROTATION POLICY FOR GROUP 'B' EXECUTIVE OFFICERS OF VADODARA ZONE
1) For the purpose of the transfer policy. Vadodara Zone is
treated as comprising, of three stations namely, Vadodara (Vadodara-I & Vadodara-II), Surat (Surat-I and Surat-II) and Daman (Vapi & Daman).
2) The normal tenure of a station shall be eight years. The
normal tenure in a Commissionerate shall be four years. For
counting one year of posting at a station, the margin of 3
months would be considered e.g. if an officer has completed 9
months to 15 months as on 30th June, it will be considered
one year of posting.
3) In cases of promotion, the general rule will be transfer out
of station on promotion.
4) The criterion for determining the Commissionerate Seniority
shall be as follows;
4.1) The Commissionerate seniority for the purpose of AGT shall be computed on the basis of length of continuous stay in the concerned Commissionerate in the grade of Inspector (for Inspector grade) and in the grades of Inspector and Superintendent taken together (for Superintendents grade), after excluding the period of stay on deputation/ loan basis/ Customs posting, either at the same station or outside. Thus, if between two successive postings in the same Commissionerate, the officer has been posted outside the Commissionerate on deputation/ loan basis/ Customs posting, while the said period of deputation/ loan basis/ Customs postings shall be excluded while computing the period of stay in the Commissionerate, such postings shall not amount to a break in the stay at the Commissionerate.
4.2) Posting in a different Commissionerate, either at the same station or otherwise shall be considered as a break in continuous stay in the Commissionerate, if that stay is for at . least one year or more.
4.3) Further, in cases of change of jurisdiction of a Commissionerate e.g. during cadre restructuring etc., postings at places falling within the present jurisdiction of the Commissionerate which earlier fell in the jurisdiction of another Commissionerate- shall be treated as a posting in the present Commissionerate. Thus, for example, a posting in Halol, which presently falls under Vadodara-II Commissionerate, during the period prior to cadre restructuring when Halol fell under the combined Vadodara Commissionerate shall be treated as a posting in Vadodara-II Commissionerate. '
4.4) Tenure in- Chief Commissioner Office will be counted against Vadodara-I, in CCE (TAR) office against Vadodara-II and in respective' CCE (A) office against respective Commissionerate s.
5) Specific posting in each Commissionerate will be done by the respective Commissioners. Rotation from sensitive to non-sensitive charges will be done as per the guidelines issued by CBEC/ CVC/ DGOV from time to time.
5.1) While making postings/rotations within the Commissionerate, requests for outstation postings will be. considered by the Commissioner . concerned subject to availability of vacancies at such outstations.
6) In accordance with the unified transfer policy for Customs formations in Gujarat, the tenure of Customs posting is four years. For postings, officers to the Custom formations in Customs Zone in Gujarat; The Chief Commissioner, Central Excise & Customs,. Vadodara shall made available the pool of officers, as per the' sanctioned/ working- strength of officers in Customs formations in Vadodara Zone and proportionate sanctioned/ working strength in Kandla Customs, to the Chief Commissioner of Customs, Gujarat, who would further decide their posting.
7) The existing system of deputation to Kandla from Vadodara Zone and Ahmedabad C. Ex Zone will be discontinued. Vadodara Zone will provide the requisite number of officers so as to cover the number of posts in for Ahmedabad Customs which relate to South Gujarat and the. number of posts in Kandla proportionate to its sanctioned strength.
8) Sourcing of staff, for the Customs Zone will be done in the following manner:
Vadodara Central Excise Zone shall post the officers to Customs Zone as per below mentioned criteria. There will be three lists of officers from the Zone.
Two-third of the .total allocated staff by the Zone shall be those officers, who have had no previous experience of working in Customs. This set of officers shall be further divided into two sub-categories:-
a.) 70% of the said officers shall be the senior-most officers, in terms'of their seniority-cum-fitness.
b.) 30% of the said officers shall be the junior-most officers, in terms of their juniority.
One-third of the total allocator! staff shall be those officers, who have had previous experience of working in Customs. For this purpose, the officers with longest gap from their previous customs posting shall be considered. The selection for posting in Customs Zone will take into account fitness as well.
9) All requests for deputation to other organizations like DGRI DGCEI/ .Other Directorates/ EPZs and Commissionerates outside the Gujarat cadre should be forwarded to the cadre controlling authority viz. Vadodara-1 who shall, obtain the approval of Chief Commissioner before forwarding the same to other organizations.
10) All requests for transfer from Vadodara Zone to ; Ahmedabad Zone and vice-versa will be done with the mutual consent of Chief Commissioner of Central Excise Vadodara •and Chief Commissioner of Central- Excise, Ahmedabad. While posting officers to Ahmedabad Zone and Vadodara Zone at the time of recruitment/- promotions/ transfers, efforts will be made to ensure same proportionate working strength to the extent possible in both the Zones.
11) Cut off date for calculation for the period of stay at a Commissionerate/ Customs posting will be 30th June.
Deviations from the policy, if any, shall be with the approval of the Chief Commissioner, Central Excise, Vadodara. Notwithstanding anything contained in this policy, the administration has, the right to transfer any officer to any formation within the combined Gujarat-cadre at anytime in public interest or on administrative grounds without assigning any reasons.
Guidelines for Transfer / Rotation / Posting Policy in Ahmedabad Central Excise Zone
The Ahmedabad Central Excise Zone consists of Central Excise Commissionerates of Ahmedabad-I, II, III, Rajkot, Bhavnagar and Commissioner, Service Tax. Ahmedabad.
2) The officers in the Ahmedabad Central Excise Zone are liable to be transferred anywhere in the jurisdiction of Ahmedabad Central Excise Zone. The officers are also liable to be posted anywhere in the jurisdiction of Gujarat Customs Zone as officers of customs
3) The Ahmedabad Zone will consist of 2 sectors namely, Ahmedabad and Rajkot Sector.
a. Ahmedabad Sector will consist of Ahmedabad C.Ex Commissionerate- I/II/III and Service Tax Commissionerate, Ahmedabad.
b. Rajkot Sector will have jurisdiction of Rajkot C. Ex Commissionerate and Bhavnagar Commissionerate.
4) The normal tenure of posting in a Sector will be for 8 years The normal tenure in a Commissionerate shall be of 4 years. After completion of 8 years in one Sector, the officer will be posted for 4 years in the other Sector.’
5) All posting and transfers in both the Sectors will be done by the Office of Chief Commissioner; C. Ex., Ahmedabad Zone. In cases of promotion, the general rule will be transfer out of station on promotion.

7.4) Tenure in Chief Commissioner Office and-CESTAT will be counted against Ahmedabad-I and in respective CCE (A) office against respective Commissionerates.
8) Specific positing in each Commissionerate will be done by the respective Commissioners. Rotations from sensitive to non- sensitive charges will be done as per the guidelines issued by CBEC / CVC / DGoV from time to time.
9) Cut off date for calculation for the period of stay at a Commissionerate/Customs posting will be 30th June. For counting One Year of posting at a station, the margin of 3 months would be considered. For e.g. if an officer has completed nine months as on 30th June, it will be considered one year of posting.
10) While making postings/ rotations within the Commissionerate, requests for outstation postings will be considered by the Commissioner concerned subject to availability of vacancies at such outstations.
11) All requests for deputation to other organizations like DGRI/ DGCEI/ Other Directorates/ EPZs and Commissionerates outside the Gujarat cadre should be done with the approval of Chief Commissioner, C. Ex., Ahmedabad Zone before forwarding the same to other organizations.

14) The existing system of deputation to Kandla from VadodaraZone and Ahmedabad C. Ex Zone will be discontinued. Ahmedabad Central Excise will provide the requisite number of officers so as to cover the number of posts in for Ahmedabad Customs and Jamnagar Customs and the number of posts in Kandla proportionate to its sanctioned strength.
15) Sourcing of staff for the Customs Zone will be done in the following manner:

1. Introduction:
In order to create an efficient delivery system, a review of the present system .of transfer and posting has been carried out. The present system of deputation to Kandla Commissionerate has failed to sustain the administrative and qualitative requirement keeping pace with, the changing economic scenario. The pattern of posting in other Commissionerates by different formations have failed to create a sense of belongingness and commitment towards the respective Commissionerates of the customs Zone. Further in the present policy of posting all officers could not get an adequate exposure in the field of Customs. Therefore, a revised new. transfer/ placement/ deputation policy (hereinafter referred to as the transfer policy) for Gr. "B" Gazzetted and Gr. "B" Non- Gazzetted executive officers posted to Gujarat Customs Zone has been formulated.
2. Salient features of Transfer Policy;-
The existing system of deputation to Kandla from Vadodara and. Ahmedabad Central Excise Zone will be discontinued.
Vadodara Zone and Ahmedabad Central Excise Zone are the feeder zones for Ahmedabad Customs Zone.
Gr. "B" Gazzetted and Gr. "B" Non- Gazzetted executive officers will be posted to Gujarat Customs Zone from Central Excise, Vadodara Zone and Central Excise Ahmedabad Zone.
All officers to be posted in Customs will be placed at the disposal of the office of Chief. Commissioner of Customs. The office of Chief Commissioner of Customs shall in turn allocate them to the three Commissionerates falling in the zone.
In accordance with the terms and conditions of appointment, officers are liable to be transferred and posted to any place in the jurisdiction of Gujarat Customs Zone.
3. Sourcing of Staff for the Customs Zone:
The existing system of deputation to Kandla from Vadodara Zone and Ahmedabad Central Excise Zone will be discontinued Vadodara Zone and Ahmedabad Central Excise Zone are the feeder, zones for Ahmedabad Customs Zone. Taking into account the total sanctioned strength of the Customs.Zone, allocation from the two feeder zones will be as follows:
1 Vadodara Zone will provide the requisite number of officers so as to. cover the number of posts in Ahmedabad Customs Zone which relate to South Gujarat and the number of posts in Kandla proportionate to its sanctioned strength.
2 Ahmedabad Central Excise will provide the requisite number of officers so as to cover the number of posts in for Ahmedabad Customs and Jamnagar Customs and the number of posts in Kandla proportionate to its sanctioned strength.
4. Criteria for posting in Customs Zone-
Both Central Excise Zones shall"post the officers to Customs Zone as per below mentioned criteria.
There will be three lists of officers from each Zone (total six lists from both the Zones).
1. Two-third of the total allocated staff by each zone shall be those officers, who have had no previous experience of working in Customs. This set of officers shall be further divided into two sub-categories.-
a. 70% of the said officers shall be the senior-most officers, in terms of their seniority-cum-fitness.
b. 30% of the said officers shall be the junior-most officers, in terms of their juniority.
2. One-third of the total allocated staff shall be those officers, who have had previous experience of working in Customs. For this purpose, the officers with longest gap with their previous customs posting shall be considered.
5. Posting of officers to Customs Commissionerate:
The office of Chief Commissioner of Customs shall allocate them to the three Commissionerates falling in the zone. Officers allocated to the Customs zone shall be liable to be posted to any place in the jurisdiction of Gujarat Customs Zone. The Chief Commissioner of Customs shall allocate these officers to the three Commissionerates in a random manner. The background and suitability of the officer concerned as also administrative requirements shall be considered while allocating the officers to a particular Commissionerate.
I Officers from South Gujarat zone shall not be posted in the same station, where they were working before being allocated to Customs zone'.
6. POLICY TO BE FOLLOWED BY THE COMMISSIONERATES:
Every Commissionerate shall classify all its stations into three categories which will generally have a maximum of tenure as mentioned below:
Category 1: 4 years (maximum)
Category 2: 2years
Category 3:. remote/ difficult/ hard postings with one year tenure
The above categorization would be based on the level of development of the place, its connectivity, availability of medical, educational and other amenities, etc. A Commissionerate may not have all the three categories.
All posts in a Commissionerate shall be divided into two categories, namely, sensitive and non-sensitive. Officers would be, generally, rotated from sensitive to non-sensitive post after a fixed tenure. Ordinarily, an officer ' ; shall not be posted for more than two years in a sensitive post. Integrity and efficiency of officers would be the main criterion for posting of officers to sensitive posts.
All annual transfer/ placement orders shall normally be issued by 15th May with the directions to join new place of posting by 31st May.
Before commencing work in Customs, officers will compulsorily undergo training.
The tenure of postings for appraising work may be fixed by the Commissionerate in a way that appraising work is carried out smoothly and efficiently and maximum officers are exposed to appraising work. Posting to appraising work will be based on merit and suitability of the officer for the job. Officers against whom vigilance/ non-vigilance cases are pending/are being contemplated by competent authorities shall not be posted to any sensitive postings till they are exonerated from all charges.
Grievances, if any, arising out of the implementation of the transfer policy shall be expeditiously disposed of by the concerned Commissioner of Customs.
7. Posting/Deputation to SVP International Airport, Ahmedabad:
75% of the posts is to be filled from the officers of the controlling Commissionerate: Ahmedabad Customs . Commissionerate and 25% from other Commissionerates on deputation basis.
8. Tenure of Posting:
(I) Tenure of posting to a Customs Commissionerate would ordinarily, be four years. Period of tenure shall be counted. from annual general transfers and not from a specific date of joining.
Tenure for posting either on regular or on deputation to international Airport, Ahmedabad, would be two years.
9. Posting on compassionate ground:
(i) In case an officer seeks a posting to a particular
station in the Commissionerate on medical grounds, Commissioner is empowered to take a decision on genuine request.
