Your kind
attention is invited to this Association’s letter dated 15.05.2012 and the
letter F.No.II/03-05/CCO/2012 dated 16th May, 2012 issued by the
Joint Commissioner(CCO), Central Excise, Ahmedabad.
Vide
above letter, the Joint Commissioner(CCO) has circulated revised list of
Superintendents and Inspectors who are likely to be posted to Customs
formations. On comparison of the list with the list circulated vide letter
dated 27th April, 2012, it appears that names of some of the
officers have been omitted and in order to offset them, the names of some of
the officers, which did not figure in the first list circulated on 27th
April, 2012, have been included.
In light
of the above, it is presumed that names of the officers supposedly having
credentials under cloud have been omitted and they have been debarred from
performing their duties under Customs formations.
As per
existing instruction, the officers under cloud/vigilance are not considered for
deputation posts and apart from that, they are not being given any sensitive
charge. However, it is to submit that posting to Customs formations cannot be
compared with deputation posts. There are number of non-sensitive posts located
at various Customs formations and these officers can be accommodated at these
non sensitive places. Moreover, there is no provision in the existing policy
that officers under vigilance/cloud shall not be considered for Customs charge.
In past also, there are number of cases
where the officers from Rajkot sector were posted to Customs charge and they
were given non-sensitive charge within customs formation. It appears that this
unjust view is taken to insulate some of the officers of Ahmedabad Sector. Much
exercise is being done just to favour Ahmedabad Sector officers, resulting in
delay of orders.
Under
these circumstances, it is requested to include the names of officers under
cloud/vigilance in the list of Superintendents and Inspectors likely to be
posted to Customs charge.
Apart
from the above, this Association submit
following few points for posting officers to Ahmedabad sector
1.
Central
Excise Commissionerate, Rajkot is the prominent revenue generator in the
Ahmedabad zone and bears the maximum work load. Revenue, workload and distant
formations need maximum number of officers to manage the Commissionerate.
Whereas Ahmedabad-i/ii/iii Commissionerate do not come in parity and minimum
staff is required to run these Commissionerates. Therefore proportionate
working strength of this Commissionerate may be increased.
2.
Efforts
may please be made in order to post the officers whose dossiers have been
forwarded to the Cadre Controlling Commissionerate i.e. Central Excise,
Vadodara and they may be posted to Ahmedabad zone in lieu of the officers being
repatriated from Customs formations as majority of them have worked at 2-3
stations during their posting under Customs formations.
3.
Wiling
officer may be posted to Ahmedabad Sector as per existing policy (Central
Excise) wherein officers are posted from one Sector to another Sector for a
period of one year.
