CIRCULAR

            A joint meeting of the members of both the Superintendents and Inspector’s Association, Rajkot Branch is being convened on 02.02.2014 Sunday at the below mentioned address at 10:30 Hrs :-

                Rajkot.
 
The agenda of the meeting is as under:

1.      On request by the Chief Commissioner, Central Excise, Zone Ahmedabad, discussion on suggestions to be given for any amendment in the present Transfer/ placement policy.
2.      Arbitrary and whimsical decisions of the administration by posting direct recruit Inspectors directly to Rajkot and Bhavnagar Commissionerate, and its impact thereof.
3.      Continued apathy of the administration towards the genuine concerns of the members of AICEIA (Rajkot Branch) and further course of action, to get resolve the grievances.
4.      Annual General Transfer, 2014 and decision regarding routine posting of encadred post of SEZ at the time of AGT.
5.      Any other issue with the permission of the Chair.
All the members Superintendent and Inspector’s Association, Rajkot Unit/ Branch are requested to attend the meeting and give their valuable suggestions/ inputs for welfare of the members and to make this Association strong. Remember, united we stand, divided we fall.

Letter to the Cheif Commissioner, C.Ex., Ahmedabad reg. non-forwarding of applications

Respected sir,

Sub.:   Non-forwarding of representations / Transfer Applications to competent authority.

It has been brought to the notice of the Association that the Representations/ Transfer Applications submitted by the Inspectors serving at Bhavnagar Commissionerate are not being forwarded to the competent authorities i.e your good office and to the Commissioner, Rajkot Commissionerate. The reason cited being that there is acute shortage of staff at Bhavnagar Commisssionerate and hence no one can be relieved so, the representations need not be forwarded.

The officers have their personal reasons, also some difficulties and their transfer requests which they want to put up to your good self / competent authorities for kind consideration. However these applications are not being forwarded to you or Commissioner, Rajkot. The reason given is also not satisfactory and justifying. Sir, when representations made for Inter Commissionerate Transfer have been forwarded and also the officers in the grade of Inspectors have been relieved, there seems to be no justification for non-forwarding of representations/ transfer applications made by  officers on various grounds. Injustice and unequal treatment is done to these officers by not forwarding their Transfer Applications by the concerned Section. Further various instructions are issued stating that the representations / transfer applications received by the administration may be forwarded to the competent authorities.

In view of above, it is requested to kindly issue suitable directions to Bhavnagar Commissionerate regarding forwarding of Transfer Applications to the competent authority at the earliest.

Association would be greatly indebted to your Honour if the above concerns are looked in to favorably.

Letter to the Chief Commissioner of Customs, Ahmedabad Zone reg. ICT applications

Sub.:   Non Forwarding of Inter Commissionerate transfer applications to competent authority.

Kindly refer to the Board’s circular F.No. A.22015/23/2011-AD-III.A dated 27.10.2011vide which ban on Inter Commissionerate Transfer in respect of willing officers in Group “B”, “C” &”D” posts under CBEC has been lifted.

In this connection it has been brought to the notice of the association that the Inter Commissionerate transfer applications submitted by the Inspectors of Custom Preventive Commissionerate, Jamnagar were not forwarded to the Chief Commissioner Customs, Ahmedabad. However after reply to various queries by the administration and personal persuasion/ request by the individual officers and association their applications were forwarded to the Chief Commissioner Customs, Ahmedabad office after almost one and a half year.

Now these applications of Inter Commissionerate Transfer transferred are stuck up at Chief Commissioner Customs, Ahmedabad office and are not being forwarded to the competent authority i.e. Chief Commissioner, Central Excise Zone, Vadodara (the cadre controlling authority) for onward transmission.

Sir, after various representations and vigorous efforts made by national Association ban was lifted by the Board to provide an equal opportunity to all the officers who wanted to be transferred to or near to their home town or their home state subject to their losing of seniority. Some officers of Customs Preventive Commissionerate Jamnagar who have submitted Inter Commissionerate Transfer application are being deprived from the benefits of this policy framed by Board. Injustice and unequal treatment is done to the officers of Custom Preventive Commissionerate, Jamnagar by not forwarding of their ICT applications  by the administration  because on other hand ICT applications received from other Central Excise Commissionerate of the Zone and of other Zones are being forwarded to the competent authorities and also the ICT orders are also being issued.

In view of above it is requested to kindly forward the Inter Commissionerate Transfer Applications submitted by the officers of Customs Preventive, Jamnagar, which fulfill the conditions as liad down in the aforesaid circular, to the competent authority at the earliest. Further it is also requested to kindly issue suitable instructions the Customs Commissionerate, Jamnagar to forward the application to your office at the earliest upon receipt of the same by their office.

Representation dated 22.11.2013 made to the Chief Commissioner, C.Ex. Ahmedabad



A representation letter was submitted by the Office Bearers of the Association to the Chief Commissioner, Central Excise, Ahmedabad during his visit t0 C.Ex. Rajkot Commissionerate on 22.11.2013. The text of the letter is reproduced below :

Respected sir,

Kindly refer to the Estt. Order No. 100/2013 dated 28.10.2013 issued by the Office of The Chief Commissioner , Central Excise & Service Tax Vadodara Zone vide which order of Zone wise allotment of newly recruited Inspectors candidates were issued.

Sir, during the AGT-2012 and 2013 some Inspectors of Central Excise Rajkot Commissionerate and some officers on repatriation from Customs Preventive Jamnagar were posted to Bhavnagar Commissionerate to fill the deficiency of Inspectors as per the existing transfer policy for a period of 1 year. These officers are to be repatriated back to their parent Commissionerate i.e. Central Excise Rajkot Commissionerate as per the transfer policy.

In this connection, your kind attention is invited to the Transfer Policy for Rajkot Sector framed by the Hon’ble Chief Commissioner, Central Excise, Ahmedabad vide his office letter F.No. II/3-11/CCO/2002 Pt.-I dated 13.05.2009 wherein the posting of officers to Central Excise Bhavnagar Commissionerate is elaborated at para (4) which reproduced below for ready reference :

            (4)        In case of deficiency/vacancy in the number of officer in Bhavnagar Commissionerate, subject to administrative exigencies, the officers shall be posted in the following manner.

(i)         the officers who are willing to work in Bhavnagar Commissionerate may be given priority;

(ii)        newly recruited officers shall be posted at Bhavnagar  Commissionerate;

(iii)       Officers posted from Ahmedabad Sector may be posted to Bhavnagar Commissionerate;

(iv)       If there is shortage of officers, even after above exercise, then newly promoted officers may be posted and, if still required, senior most officers in terms of tenure in Rajkot Commissionerate may be posted to Bhavnagar Commissionerate;

(iv)       Except on administrative exigencies, tenure of officer posted to Bhavnagar from Ahmedabad Sector as well as Rajkot Central Excise will normally be same.

In the aforesaid transfer policy the criteria of posting of officers in Rajkot Sector is also mentioned which says that the officers to be posted to Rajkot Central Excise Sector (comprising of Central Excise Rajkot and Bhavnagar Commissionerate), the administrative control shall vest with Commissioner, Central Excise, Rajkot.

Recently newly recruit officers are posted to Central Excise Zone, Ahmedabad and are to be further posted to the Commissionerates of the Zone.

The Association would like to suggest that in light of guidelines of transfer policy the newly recruited Inspectors may first be posted to Rajkot Central Excise Sector and further as per para 4 (ii) of the existing transfer policy newly recruited Inspectors may be posted to Bhavnagar Central Excise, Commissionerate in substitute against the officers who may be transferred from Bhavnagar Commissionerate to Rajkot Commissionerate i.e. to their parent Commissionerate. By posting such newly recruited officers would help to have a permanent strength of Inspectors in Bhavnagar Commissionerate.

Meeting of AICEIA Rajkot Branch




The Office Bearers of All India Body of the Inspectors’ Association will be on tour of Gujarat during the first week of September, 2013.

A meeting of All India Central Excise Inspectors’ Association Rajkot Branch representing Inspectors of Central Excise Rajkot & Bhavnagar Commissionerates and Customs Jamnagar Commissionerate is organized on Sunday 01.09.2013 at 10:00 AM at Room No. 401, Central Excise Bhavan, Race Course Ring Road, Rajkot.

Shri Ajit K.G., Secretary General along with the President and other All India Office Bearers will take the above meeting. The meeting will be followed by lunch. All the members of the Association i.e. Inspectors of Central Excise Rajkot & Bhavnagar Commissionerates and Customs Jamnagar Commissionerate are requested to attend the meeting and make it grand success.
