Comments on amendement in Transfer Policy

Sub: Issues raised by the various Association regarding the existing transfer/ rotation policy: Matter regarding.

                Kindly refer to your letter F.No.II/3-02/Estt/CCO/2013 dated 07.02.2013 on the captioned subject.

On behalf of all the members of both the Associations, we profusely thank the administration for looking into the grievances of the members of the Associations and the keenness demonstrated to amend the existing policy for better. The members of both the Associations are rejoiced at the present move and intent of   administration to provide even better policy which would be more convenient and convenient to the administrations and also the members of the Associations. However, the members of the Association have raised concern over the execution part of the policy, as the same is often not followed in letter and spirit. However, the Association is quite confident that the execution and implementation part of the Transfer and Posting Policy will be sufficiently taken care of henceforth. 
            
               In this connection, as desired the suggestions / comments regarding amendment in the existing transfer policy for Customs, are submitted hereunder;
CUSTOMS:
i)                    Before including the names of the officers of Central Excise for posting to Customs charge, willingness may be called for from officers and willing officers may be accommodated in Customs formations in order to minimize the displacement of officers.
ii)                  Officers of Rajkot Sector will provide the requisite number of officers so as to cover the number of posts in CCP, Jamnagar and the officers of Ahmedabad Sector may be posted within the concurrent CCP jurisdiction only i.e. CCP Ahmedabad.
iii)                The officers of Ahmedabad Central Excise Zone (Central Excise Rajkot and Ahmedabad Sector) will only provide requisite number of officers as to cover the number of posts in Kutch Commissionerate.
iv)                The present policy for posting to Customs formations is very complicated one as the same incorporates a number of criterions. Instead of that, there should be a simple policy wherein firstly the willing officers may be posted to Customs formations and there after if still vacancies exist the officers who have never worked under Customs Charge should be posted to Customs charge and thereafter, the officers with longest gap may be considered.
v)                   It is the earnest request of the Association to maintain transparency by circulating the list of officers who are due for transfer to Customs well in advance (at least 2-3 months, by at least 28th February). The vacancy position of various formations/ Divisions of Customs Zone and also Central Excise may be declared /displayed on web site and also provided to the association. This will help the members to prepare and equip themselves for posting at new place in customs formation, in advance. The history of postings must be updated and placed on the web site of the respective Commissionerate.
vi)                It is seen in last AGT that full working strength is allotted to Kutch Commissionerate Kandla and Ahmedabad Customs, whereas number of posts are kept vacant at Jamnagar Commissionerate. Looking towards the contribution made at revenue and considering national security, these vacancies creates a threat as the Jamnagar Commissionerate has got long coastline. So the members of this Association are of view that the administration should allocate the staff to the Customs Commissionerate in more proportionate manner, and even accord little priorities to Customs Jamnagar Commissionerate.
vii)              The officers should be posted to their parent Commissionerate on repatriation from Customs after completion of their tenure of posting of Customs.

CENTRAL EXCISE
i)          The existing policy for Rajkot Sector is quite hassle free and no change / amendment is suggested or warranted in the said policy. But once again the Association requests your honour to see that it is implementation part is not skewed and selective.
ii)         A few officers working in Rajkot sector are having their genuine request pending for inter-Commissionerate transfer to Ahmedabad since long. There is apparently no restriction or ban in the existing policy even though their requests are not being considered. So your honour is requested to consider the genuine request of the members of the Rajkot sector.
      It should be ensured that the Orders for posting to Customs Commissionerate get issued in the month of March so that the AGT process of Central Excise can be completed by April / May.
      Should the  administration deem fit to have for further deliberation and dialogue, the representative of this association would be more than willing to explain the issues and situation in person.
