Sub: Annual General Transfer in the grade of Superintendent & Inspector (AGT-2011) – regarding.

Please refer to letter F. No. II/3-13/2011-Estt. Dated 7.6.2011 of A. O (Estt.), Central Excise, HQ, Rajkot on the above subject.

2. Through above letter, a proforma to be filled by Superintendents and Inspectors working under this Commissionerate is circulated, asking them to provide certain details, including “Preference of Station in order of priority” at Sl. No. 9 therein.

3. By calling for above preference, it appears that all the Superintendents and Inspectors of this Commissionerate are being considered for transfer throughout the Zone, irrespective of Station/formation (Customs/Central Excise/Service Tax), etc.

4. In all earlier AGT, officers of this Commissionerate who were due for transfer to Customs Commissionerate, Jamnagar or who had completed six years tenure in Rajkot were invariably asked to give their choice of station before issuing any transfer order. This time also, this procedure is already concluded and officers have already given their choice, details of which are available on record.

5. At this point in time, it would be relevant to point out that this Association has already made it clear at every given opportunity that we are against any deviation in existing transfer & posting policy framed for Rajkot Sector by the then Chief Commissioner of Central Excise, Ahmedabad. Moreover, only those officers can be asked to give preference, who is being considered for transfer in accordance with the existing policy and not all. Therefore, there is no apparent reason for calling for these details.

APPEAL MEMORANDUM

The issue of Transfer Policy has been making rounds for around six months by the Administration. Only after the Association met the Administration requesting to issue Annual General Order, the Administration woke up from slumber and reluctantly involved the Association at the eleventh hour to deliberate upon the new draft policy regarding Annual Transfers. Consequently, from 18/05/2011 the Association alongwith its members have been working sincerely seeking opinion of members by arranging meeting of members at different stations. After having deliberation at length with members, the Association came out with a opinion that, the new draft policy may create undue displacement officer leading to pandemonium. During the course, the office bearers of each unit of the Association had meeting with the administration twice at length. Chief Commissioner, other Commissioners and number of Office bearers sat together for long hours and had deliberation on draft policy in depth in cordial atmosphere. Without going into the pros and cons of the draft policy, but a consensus was arrived at the meeting that the time was not appropriate to call for a new transfer policy. Reasons for ill timed implementation of transfer policy were deliberated with the administration. The main reason being that it was badly delayed and new policy would only cause further delay. But the administration was of he opinion that, the orders would be issued soon without further delay. However, even after the lapse of 11 days counting 26/05/2011, (though administration was already sitting on it for more than six months) the administration has not come with any concrete outcome. And at this juncture, it is highly difficult to anticipate the date of final transfer orders.

Since 03/06/2011 all members of the Association are on agitation in form of relay hunger strike to resolve the issue. In addition to this, Board was requested through national representatives to positively intervene in the matter. Incidentally, it is learnt that necessary instructions was relayed by Board to the administration. However, nothing constructive has come out till date.

This protest has made the administrative to rethink to implement the proposed policy. But no fruitful outcome has emerged. Hence, it is felt that the situation should not be allowed to drift aimlessly, which is clearly a waste of manpower.

All office bearers should sit together and take stock of prevailing fluid situation and try to resolve the issue. It is learnt that, the Chief Commissioner is in Ahmedabad on Friday. Hence, it is requested that all the office bearers should meet at Ahmedabad at 10.00 AM to form of a consensus and also meet the Administration to settle the issue by Friday evening.

Respected Madam,

Sub. : Request to intervene in the matter and direct the Chief Commissioner Madam to issue Annual General Transfer orders at the earliest.

Kindly refer to our earlier correspondence on the subject matter.

In this regard, it is to inform that, the academic year has already commenced from 6/6/2011. However, till date the administration is only exercising the power in framing the TRP. The fate of the officers and their children are in dark. A draconic sword is hanging on their head.

Your honour is requested to kindly direct the local authorities to issue minimum required transfer order as per existing policy at the earliest so that the transferred officers can settle at the new place of posting and the administration can run smoothly. Madam, officers promoted to the grade of Superintendent more than two months back are not yet posted, gravely affecting the administration to no end. It is largely believed that your honour will positively intervene in the matter and induce an atmosphere to bring back normalcy which is in the larger interest of the department. Kindly, assign priority ton the issue and issue suitable direction.

PRAYER: In the interest of the administration minimum transfer orders may be issued at the earliest.

One instant suggestion that I would like to make to all brother Inspectors & Superintendents working in Rajkot Sector & Rajkot Commissionerate in particular is:

"We must by now realize that our Ahmedabad colleagues are sitting pretty tight because they have some kind of assurance that they would continue to stay at Ahmedabad more than me and you can continue to stay at any particular station, namely, Rajkot, Jamnagar, Gandhidham, Bhavnagar, etc. They are therefore reluctant, and understandably so, to join us in the ongoing strike. One way in which I think our Ahmedabad brothers can be woken up is: LET EACH OF US REQUEST FOR OWN COST INTER-COMMISSIONERATE TRANSFER TO AHMEDABAD. Let there be en bloc exchange between us and Ahmedabad. I strongly believe that this will serve atleast one objective of Madam - to obliterate 'localised factor' since Ahmedabad brother are obviously more localized than me and you having stayed at Ahmedabad more than me and you have stayed at Rajkot and other places.

Letter to Hon'ble Member (P&V), CBEC, New Delhi

Hon'ble Madam,

Regards.

Your honour is being briefed in detail by our Secretary general about Gujarat's problem. We too have sent much deliberation to your honour. In nut shell we request your honour to consider the following points and intervene into the matter.

1. The Chief Commissioner Madam is being briefed in detail and requested to keep in abeyance the new policy till the restructuring is materialized.

2. At least 300 posts of Assistant Commissioner and 300 posts of Superintendents and few more zones will be coming in Gujarat. Due to this 900 officers will be promoted and displaced and new zones will emerge from the existing formations. It is crystal clear that in that development what will be the fate of this newly born baby (Draft Policy).

3. AGT is badly delayed. All officers who are due for transfer/not due for transfer have already paid the fees and academic year has started. At this juncture you can understand the fate of children education.

4. The chief Commissioner Madam repeatedly says that she will not displace much. We want to know that when she don't want to displace the officers, why she want the new policy implemented immediately.
