Agitation program on 26th September

Message from Secretary General, AICEIA :


Comrades,

Please go all out to make the Agitation on 26th September'12 a huge success. We have to make our collective  voice heard to get our just demands conceded by the Government.

On the call of the Joint Action Committee of Associations in the CBEC and the Superintendents' Association, each one of us  has to wear a black badge, observe a daylong fast and participate in a protest meeting during the lunch break on 26.09.12 in support of our Charters of  Demands. 

AICEIA  office bearers should kindly co-ordinate at regional and local levels  with the Associations of Superintendents, Ministerial Officers, Drivers, Sepoys and Hawaldars, Telecommunication Staff and all others to make the programme a massive success.

Meetings during Lunch break must be held jointly, and the following savingram suggested by the JAC should be sent to both the Revenue Secretary  as well as the Chairperson CBEC in separate envelopes by Speed Post  to effectively register our  just and collective protest at the appropriate level.

Its the time to refocus ..!


Dear Members,
 
The AGT-2012 orders have already been issued in Ahmedabad Central Excise Zone. Largely, the orders have been found to be as per the existing guidelines/policy. Due to the existing Customs Policy in Gujarat Zone, ratio of the working strength amongst Commissionerates in the Ahmedabad Central Excise Zone got disturbed resulting, at initial stage, posting of officers of Rajkot Sector to Ahmedabad Sector who were repatriating from Custom side. Lately, the administration at higher level as well as at local level extended full co-operation to consider most of the requests made by the Association at large level and by members at individual level to post willing officers to Ahmedabad Sector from Rajkot Sector and vis-a-versa except 2-3 cases. The team of Association begs pardon from the members whose requests could not be acceded to. The administration might have own reasons/compulsions for the same. On our part, there has not been any hesitation to beg for concern for our comrades in deserving cases, and on the part of whole team, it is assured that there will never be any hesitation to work for the welfare of our cadre in future also.

This association looks forward for suitable amendment in the existing transfer policy in the larger interest of the cadre and the administration as well.

So, it is now time to refocus on the issues and carry on the work relating to the welfare of our cadre as well as other cadres working side by side. The problems relating to work-friendly environment, adequate and latest infrastructure still persist, especially in the Customs formation in Customs (Prev.) Jamnagar Commissionerate. However, the good work done by the administrative authorities in Central Excise Rajkot & Bhavnagar Commissionerates cannot be belittled. So we have to work together and persuade the authorities to further improve the working conditions in our offices because the work-place is our second home, where we spend our considerable time.

Besides above, our cadre is also facing problems relating to stagnation and other issues relating to pay-scales/grade pay etc., which need urgent attention. The Joint Action Committee consisting of the Inspectors of Central Excise, Ministerial Officers and other group “C” cadres at the national level, has given a call for rally at Jantar Mantar, New Delhi on 27.07.2012. A circular has already been issued by the Secretary General of our Association and placed on our blog and website of All India body (“aiceia.blogspot.com”). We have to be ready and united for making this agitational programme a successful event because the various meetings with and assurances of the CBEC authorities and the Revenue Secretary as well as Finance Minister have so far failed to yield any positive results. The DPC for the existing vacancies of the Assistant Commissioners is not being held nor is the ratio as per the latest Apex Court directions being implemented, which has not only resulted in denial of promotions to the Superintendents, but also denied the percolation benefits down the line to our cadre as well as other ministerial/group “C” cadres.

I hope that all the members of our cadre will whole heartedly participate in the agitational programme and dedicate one day to the common causes irrespective of personal problems and personal differences of opinion, if any. United we stand and may win, divided we will fail to achieve our genuine long-standing goals. We must act now, because it is now or never situation; and also a stitch in time saves nine.

Letter dtd. 17.05.2012 to CC, C.Ex., Ahmedabad

Respected sir,

            Your kind attention is invited to this Association’s letter dated 15.05.2012 and the letter F.No.II/03-05/CCO/2012 dated 16th May, 2012 issued by the Joint Commissioner(CCO), Central Excise, Ahmedabad.

            Vide above letter, the Joint Commissioner(CCO) has circulated revised list of Superintendents and Inspectors who are likely to be posted to Customs formations. On comparison of the list with the list circulated vide letter dated 27th April, 2012, it appears that names of some of the officers have been omitted and in order to offset them, the names of some of the officers, which did not figure in the first list circulated on 27th April, 2012, have been included.

            In light of the above, it is presumed that names of the officers supposedly having credentials under cloud have been omitted and they have been debarred from performing their duties under Customs formations.

            As per existing instruction, the officers under cloud/vigilance are not considered for deputation posts and apart from that, they are not being given any sensitive charge. However, it is to submit that posting to Customs formations cannot be compared with deputation posts. There are number of non-sensitive posts located at various Customs formations and these officers can be accommodated at these non sensitive places. Moreover, there is no provision in the existing policy that officers under vigilance/cloud shall not be considered for Customs charge. In past also, there are number of  cases where the officers from Rajkot sector were posted to Customs charge and they were given non-sensitive charge within customs formation. It appears that this unjust view is taken to insulate some of the officers of Ahmedabad Sector. Much exercise is being done just to favour Ahmedabad Sector officers, resulting in delay of orders.

            Under these circumstances, it is requested to include the names of officers under cloud/vigilance in the list of Superintendents and Inspectors likely to be posted to Customs charge.

            Apart from the above, this Association   submit following few points for posting officers to Ahmedabad sector

1.     Central Excise Commissionerate, Rajkot is the prominent revenue generator in the Ahmedabad zone and bears the maximum work load. Revenue, workload and distant formations need maximum number of officers to manage the Commissionerate. Whereas Ahmedabad-i/ii/iii Commissionerate do not come in parity and minimum staff is required to run these Commissionerates. Therefore proportionate working strength of this Commissionerate may be increased.

2.     Efforts may please be made in order to post the officers whose dossiers have been forwarded to the Cadre Controlling Commissionerate i.e. Central Excise, Vadodara and they may be posted to Ahmedabad zone in lieu of the officers being repatriated from Customs formations as majority of them have worked at 2-3 stations during their posting under Customs formations.

3.     Wiling officer may be posted to Ahmedabad Sector as per existing policy (Central Excise) wherein officers are posted from one Sector to another Sector for a period of one year.

Points given by Association for discussion in the JCM held on 29.03.2012

Sub: J.C.M. to be held on 29.03.2012.

Kindly refer to your letter issued from F.No. I/22-35/2008-09/ADM dated 22.03.2012 regarding holding of J.C.M. and submission of points for discussion.

Sir, the association and its members are obliged to the managment for scheduling the Joint Consultative Machinery meeting. The following points / grievances are submitted herewith for discussion in the meeting:

1. The repair work of toilets in the Hq. building is taken up by the CPWD and same is going on in a very slow speed. The officers and specially the female officers are facing hardship. It is requested to take up the matter with the CPWD to speed up the repair work of the bath rooms.

2. Pure drinking water facility is not available in the Hq. office. Most of the water coolers are out of order and the R.O. systems are not in working conditions. This is a great threat to the health of the officers.

3. Proper parking of vehicles both 2 wheelers and four wheelers is not being done/maintained.

4. Basic amenities in the field/ lower formations mainly at Central Excise/service tax Jamnagar and Gandhidham, like proper office, sitting facilities/ space, furniture etc are not available and therefore action should be taken to improve the situation. Initiative must be taken for construction pf govt. quarters at Jamnagar and Gandhidham.

5. The criterion for sensitive and non sensitive charge is public interaction and work of assessment. After mandatory filing of return electronically the public interaction is finished/ NIL in case of service tax ranges. Hence it is requested that the service tax ranges may be considered as non sensitive. The Service Tax Division of Rajkot Commissionerate is working with sanctioned strength and working strength of 2002. There is huge work load on each officers working in this division, which can be understood by comparing the data like No. of Services, No. of Assessees, No. of adjudication, Revenue Figures, No. of Refund, No. of cases of recovery etc. in the year 2002 and in the year 2012. Against this huge revenue realization and around 25000 taxpayers the staff deployed in this division is only 34 personal (Supdt. 11+ Inspector 14). On account of acute shortage of staff in this division each officer is mentally and physically stressed. Each staff members is having additional charge. Looking to this position it is requested to kindly make the tenure of posting in Service Tax for 2 years and also the posting in service tax ranges may be considered as non sensitive.

6. The control room duty may be abolished. The officer posted in control room is merely preparing the visitors pass which is wastage of manpower. In modern time of latest communication facilities there is no requirement of control room.

7. Any other point raised during the time of meeting.

Total Health Check-up at subsidized rate.

CIRCULAR

As you all are aware that these days due to sedentary and stressful life and changed food habits there is an increase in number of life-style diseases and if not detected earlier, it may be prove disastrous.

The association feels that all the officers of our department should be cautious towards their health and accordingly, TOTAL HEALTH CHECK UP scheme has been finalized with the Wockhardt Hospital, Rajkot at subsidized rate for the benefit of our members and the members of their families.

All the interested members are requested to avail the benefit of the scheme.

Important Points:

1. It is for all the officers (including their family members) of our department irrespective of the cadre and place of posting. (Same facility will be extended by the Wockhardt Hospital Bhavnagar)

2. To avail the facility at concessional rate, Health coupons will be issued. Coupons are available with Shri Dilip. J. Pandya, Inspector, Central Excise, Rajkot.

3. Officers are requested to visit the hospital for check up only after prior appointment, for their convenience.

4. After presenting the coupons, they are required to pay as per the rates indicated against specific packages. Packages may be chosen well before issue of coupons.

5. Officers are requested to go there after observing fast of about 12 hours. Anybody having diabetes may inform the concerned doctor before the test starts. After sampling of bloods or other tests to be conducted during fast, they will provide 'snacks' and/or glucose.

6. The tests will start at around 0800-0830 hrs and will be finished at about 1400-1430 hrs.(Monday to Saturday)

7. Instructions mentioned on the coupons may be followed.
