Withdrawal of Call Not to Attend Office on 29th, 30th and 31st March' 13

Following meetings of Associations representing Inspectors and Superintendents held with the CBEC  Chairperson, Member(P&V), DGHRD and ADG(HRM) today, and letter issued by the Member(P&V) to this Association requesting for calling of the Agitation, the AICEIA, in consultation with the AIACEGEO, has decided to  withdraw the call to its members not to attend office on  29th, 30th and 31st March'13. It has been assured by the CBEC at the highest level that all issues being repeatedly agitated before them are receiving serious attention  and all efforts being made to address our grievances. To begin with, a meeting of the AICEIA office bearers has been  scheduled with the DGHRD, CBEC  on 04.04.13 to devise modalities to do away with regional disparities in promotions of Inspectors to Superintendents of Central Excise. It has also been informed by the CBEC that the Cadre Restructuring proposals have been cleared by the Revenue Secretary and the same  is presently awaiting approval of the Finance Minister, which is expected to come shortly. 
The AICEIA was represented in today's meetings by the President, Secretary General and Organising Secretary.  
All Circle and Branch Secretaries are requested to inform Chief Commissioners / Commissioners accordingly, and inform all memers of the latest developments.
AICEIA congratulates the Inspectors across the country and all office bearers who tirelessly mobilised support for this movement which alone has resulted in the issues concerning our cadre being addressed with the current urgency shown by  the  Board. Please do keep up the morale and this spirit to agitate with even more intensity if our just demands are not met very soon, and assurances given to us  not fulfilled.

              Please  refer to this Association’s letter of even no. dated 20.03.13 and the letter issued by the Member (P&V), CBEC, New Delhi under F. No. OSD/MPV/Inspector Asso. dated 22.03.13 on the captioned subject, and letter issued today by the ADG (HRM), DGHRD, CBEC conveying scheduling of meeting of the DGHRD, CBEC with office bearers of this Association on 04.04.13 to address the issue of regional disparities in promotions of Inspectors  to Superintendents of Central Excise  across various Cadre Control Zones.
           Following the referred letter issued by the CBEC requesting this Association to call off the Agitation,  and the assurances given to the Associations in the course of today’s meeting with your goodself, the Member (P&V),  and the DGHRD, the call given to the members of this Association not to attend office on 29th, 30th and 31st March’13 is withdrawn.
     However, this Association reiterates that cadre of Inspector of Central Excise continues to be  highly agitated and demoralized on account of the abject stagnation being faced by it, the absolute lack of promotional avenues, and the disparities within and among the three streams of Inspector of Central Excise/ Preventive Officer of Customs/ Examiner of Customs, and it is hoped that the move initiated today by the Board to address the same, in  response  to this Association’s demand,  would be taken forward in right earnest and  a lasting solution to the same would be found very soon as assured by your goodself today.

        The All India Association Of Central   Excise  Gazetted Executive   Officers and  All India Central Excise Inspector’s Association has given call of satyagraha/ agitational programme, in view of the continuing apathy and indifference of the CBEC and the Government of India to the appallingly poor career prospects available to Superintendent and Inspectors of Customs, Central Excise & Service Tax including abject stagnation being faced by them for decades, very wide disparities in promotions within and among the three cadres of Inspectors of Central Excise/Preventive Officers of Customs/Examiners of Customs to the Gazetted Gr. ‘B’ posts and further to the Gr. ‘A’ and several other major grievances ventilated by the Association from time to time, we are highly agitated and demoralized.

In protest against this treatment being meted out to both the cadres it has been jointly decided by All India Association Of Central   Excise  Gazetted Executive, Rajkot Unit and All India Central Excise Inspector’s Association, Rajkot Branch that no member of both the Associations will attend office on Govt. Holidays/Saturday/Sunday- 29th, 30th and 31st March, 2013 respectively.

                  Sub: J.C.M. to be held on 20.03.2013.

                  Kindly refer to the notice dated 19.03.2013 issued by the Assistant Commissioner (P&V) regarding holding of J.C.M. on 20.03.2013 and submission of points for discussion.

         The following points / grievances are submitted herewith for discussion in the meeting:               

A. Not to conduct J.C.M. for formality:  
         In this connection it is to submit that the administration must issue the notice for holding of J.C.M. well in advance which would give time to the association to collected point from various Customs formations. The J.C.M. is held to hear and resolve the grievances of the staff.  The administration has given only one day time to submit the points which shows that the administration is not interested in conducting the J.C.M. to resolve the issues but only to complete the formalities.

B.  Infrastructure :
            The major issue concerns with the availability of infrastructure at lower formations. The fact may be appreciated that basic facilities and good working environment definitely increase the efficiency of the officer. There are many lower formations including remote places where basic facilities including good office premises as well as proper furniture, computer, drinking water etc. are lacking. In the current modern era, telephone, computer, internet, photocopier machine etc. are also required for speedy communication. The Association would appreciate urgent intervention of the administration in the matter for providing good infrastructure facilities.

C. Circulation and forwarding of willingness for deputation postings.
            This Association has already taken up the matter with the administration for circulation of willingness called for by the other agencies like DRI, NCB, SEZ, International Airports etc. The willingness may be circulated to the lower formations and the willingness submitted may be forwarded to respective authorities in time.

D.  Vehicles for patrolling:
Although sufficient vehicles have been provided by the department, vehicles are not provided for the purpose of patrolling which is the most sensitive part of our duty.  It is also to be noted that the Commissionerate of Customs (Prev.) has been provided with new vehicles recently exclusively for undertaking the preventive work but same are not being used for patrolling purpose.
 
E.   Working on Saturday and Sunday:
        Notice for working of office on Saturday and Sunday are been issued at Commissionerate level frequently. The reasons for working of office on holidays are inspection of lower formations and meetings held in the Hq office Jamnagar. The orders for working of office on holidays may only be issued on directions from Board or for special measures.

F.       Any other point raised during the time of meeting.

           It is to inform that Shri Uttam Bhalsod, Inspector of Customs has been nominated to attend this J.C.M. on behalf of the association

Comments on amendement in Transfer Policy

Sub: Issues raised by the various Association regarding the existing transfer/ rotation policy: Matter regarding.

On behalf of all the members of both the Associations, we profusely thank the administration for looking into the grievances of the members of the Associations and the keenness demonstrated to amend the existing policy for better. The members of both the Associations are rejoiced at the present move and intent of   administration to provide even better policy which would be more convenient and convenient to the administrations and also the members of the Associations. However, the members of the Association have raised concern over the execution part of the policy, as the same is often not followed in letter and spirit. However, the Association is quite confident that the execution and implementation part of the Transfer and Posting Policy will be sufficiently taken care of henceforth. 
            
               In this connection, as desired the suggestions / comments regarding amendment in the existing transfer policy for Customs, are submitted hereunder;
CUSTOMS:
i)                    Before including the names of the officers of Central Excise for posting to Customs charge, willingness may be called for from officers and willing officers may be accommodated in Customs formations in order to minimize the displacement of officers.
ii)                  Officers of Rajkot Sector will provide the requisite number of officers so as to cover the number of posts in CCP, Jamnagar and the officers of Ahmedabad Sector may be posted within the concurrent CCP jurisdiction only i.e. CCP Ahmedabad.
iii)                The officers of Ahmedabad Central Excise Zone (Central Excise Rajkot and Ahmedabad Sector) will only provide requisite number of officers as to cover the number of posts in Kutch Commissionerate.
iv)                The present policy for posting to Customs formations is very complicated one as the same incorporates a number of criterions. Instead of that, there should be a simple policy wherein firstly the willing officers may be posted to Customs formations and there after if still vacancies exist the officers who have never worked under Customs Charge should be posted to Customs charge and thereafter, the officers with longest gap may be considered.
v)                   It is the earnest request of the Association to maintain transparency by circulating the list of officers who are due for transfer to Customs well in advance (at least 2-3 months, by at least 28th February). The vacancy position of various formations/ Divisions of Customs Zone and also Central Excise may be declared /displayed on web site and also provided to the association. This will help the members to prepare and equip themselves for posting at new place in customs formation, in advance. The history of postings must be updated and placed on the web site of the respective Commissionerate.
vi)                It is seen in last AGT that full working strength is allotted to Kutch Commissionerate Kandla and Ahmedabad Customs, whereas number of posts are kept vacant at Jamnagar Commissionerate. Looking towards the contribution made at revenue and considering national security, these vacancies creates a threat as the Jamnagar Commissionerate has got long coastline. So the members of this Association are of view that the administration should allocate the staff to the Customs Commissionerate in more proportionate manner, and even accord little priorities to Customs Jamnagar Commissionerate.
vii)              The officers should be posted to their parent Commissionerate on repatriation from Customs after completion of their tenure of posting of Customs.

CENTRAL EXCISE
i)          The existing policy for Rajkot Sector is quite hassle free and no change / amendment is suggested or warranted in the said policy. But once again the Association requests your honour to see that it is implementation part is not skewed and selective.
ii)         A few officers working in Rajkot sector are having their genuine request pending for inter-Commissionerate transfer to Ahmedabad since long. There is apparently no restriction or ban in the existing policy even though their requests are not being considered. So your honour is requested to consider the genuine request of the members of the Rajkot sector.
      It should be ensured that the Orders for posting to Customs Commissionerate get issued in the month of March so that the AGT process of Central Excise can be completed by April / May.
      Should the  administration deem fit to have for further deliberation and dialogue, the representative of this association would be more than willing to explain the issues and situation in person.

Agitation program on 26th September

Message from Secretary General, AICEIA :


Comrades,

Please go all out to make the Agitation on 26th September'12 a huge success. We have to make our collective  voice heard to get our just demands conceded by the Government.

On the call of the Joint Action Committee of Associations in the CBEC and the Superintendents' Association, each one of us  has to wear a black badge, observe a daylong fast and participate in a protest meeting during the lunch break on 26.09.12 in support of our Charters of  Demands. 

AICEIA  office bearers should kindly co-ordinate at regional and local levels  with the Associations of Superintendents, Ministerial Officers, Drivers, Sepoys and Hawaldars, Telecommunication Staff and all others to make the programme a massive success.

Meetings during Lunch break must be held jointly, and the following savingram suggested by the JAC should be sent to both the Revenue Secretary  as well as the Chairperson CBEC in separate envelopes by Speed Post  to effectively register our  just and collective protest at the appropriate level.

Its the time to refocus ..!


Dear Members,
 
The AGT-2012 orders have already been issued in Ahmedabad Central Excise Zone. Largely, the orders have been found to be as per the existing guidelines/policy. Due to the existing Customs Policy in Gujarat Zone, ratio of the working strength amongst Commissionerates in the Ahmedabad Central Excise Zone got disturbed resulting, at initial stage, posting of officers of Rajkot Sector to Ahmedabad Sector who were repatriating from Custom side. Lately, the administration at higher level as well as at local level extended full co-operation to consider most of the requests made by the Association at large level and by members at individual level to post willing officers to Ahmedabad Sector from Rajkot Sector and vis-a-versa except 2-3 cases. The team of Association begs pardon from the members whose requests could not be acceded to. The administration might have own reasons/compulsions for the same. On our part, there has not been any hesitation to beg for concern for our comrades in deserving cases, and on the part of whole team, it is assured that there will never be any hesitation to work for the welfare of our cadre in future also.

This association looks forward for suitable amendment in the existing transfer policy in the larger interest of the cadre and the administration as well.

So, it is now time to refocus on the issues and carry on the work relating to the welfare of our cadre as well as other cadres working side by side. The problems relating to work-friendly environment, adequate and latest infrastructure still persist, especially in the Customs formation in Customs (Prev.) Jamnagar Commissionerate. However, the good work done by the administrative authorities in Central Excise Rajkot & Bhavnagar Commissionerates cannot be belittled. So we have to work together and persuade the authorities to further improve the working conditions in our offices because the work-place is our second home, where we spend our considerable time.

Besides above, our cadre is also facing problems relating to stagnation and other issues relating to pay-scales/grade pay etc., which need urgent attention. The Joint Action Committee consisting of the Inspectors of Central Excise, Ministerial Officers and other group “C” cadres at the national level, has given a call for rally at Jantar Mantar, New Delhi on 27.07.2012. A circular has already been issued by the Secretary General of our Association and placed on our blog and website of All India body (“aiceia.blogspot.com”). We have to be ready and united for making this agitational programme a successful event because the various meetings with and assurances of the CBEC authorities and the Revenue Secretary as well as Finance Minister have so far failed to yield any positive results. The DPC for the existing vacancies of the Assistant Commissioners is not being held nor is the ratio as per the latest Apex Court directions being implemented, which has not only resulted in denial of promotions to the Superintendents, but also denied the percolation benefits down the line to our cadre as well as other ministerial/group “C” cadres.

I hope that all the members of our cadre will whole heartedly participate in the agitational programme and dedicate one day to the common causes irrespective of personal problems and personal differences of opinion, if any. United we stand and may win, divided we will fail to achieve our genuine long-standing goals. We must act now, because it is now or never situation; and also a stitch in time saves nine.
