Resolution regarding the out come of the meeting held on 26.5.2011 and 31.5.2011 at Ahmedabad with the Chief Commissioner, Customs, Gujarat Zone, Ahmedabad
We, the office bearers of the Associations, convey our thanks to Chief Commissioner of Customs Gujarat Zone, Ahmedabad, also Incharge of Chief Commissioner of Central Excise, Ahmedabad Zone, and Incharge of Chief Commissioner of Central Excise, Vadodara zone, that we were permitted to deliberate the genuine facts in the meeting. These meetings were a blending of sweet and sour experiences. Sweet, because some of our valid points regarding the issue of transfer were patiently heard and appreciated, but we call it sour also because most of our genuine difficulties could not find your compassionate approach.
As our main point of discussion resolved around Customs posting, particularly for Kandla, we the office bearers, share the justifiable problems of the administration on this subject.It is undeniable that the office bearers came up with most convincing suggestions to solve out the problem for Kandla, but the administration side seems to be adamant and guided by the pre-conceived decisions. It is therefore, unfortunate that the net result of both the meetings could not move towards any amicable solution of the problem.
Continuous and consistent efforts of the office bearers flatly failed to convince the administration that any change/deviation in the existing policy would require discreet thought on the issue and it may and must involve considerable time. So, at this point of time, submission made by the representatives which have been put forth in the meetings on 26.5.2011 and 31.5.2011 should have been given cognizance. Since those considerations have not been addressed at all satisfactorily, it has been unanimously resolved that
1. The staffing problem at Kandla, being a genuine concern of the administration, may be suitably taken up by administration. But it should be ensured that minimum no. of staff are facing the problem of displacement. Besides, the administration should look at detrimental factors of the policy, which has considerable reduced the interest of the staff in the posting at Kandla. This would be a durable solution to this problem. The views given by Association during discussion must be considered positively in this regard, viz.
(a) Cooling period should be reduced to two years
(b) Willingness from Officers from Customs should be forwarded/considered
(c) Willingness of the officers, wishing to continue in custom house Kandla, may be considered
(d) Suitable amendment in rotation in CH Kandla may be effected to generate the interest for the said posting
(e) Technical delay in processing the willingness should be avoided
(f) Posting at CH Kandla may be made alongwith AGT and no interim orders be issued.
2. In view of anticipation of introduction of GST and already processed Cadre restructuring, the department is bound to reshape the transfer/rotation policy. The overall performance of the staff members in the context of revenue is in upward trend and the climbing graph/statistics is a clear indication of our satisfactory performance. As such, there is absolutely no significance of any change in existing Transfer Policy which has yielded excellent output so far revenue is concerned and at the same time the staff members are satisfied with it. It is premature to interfere with the present transfer policy and any change in the present policy is not acceptable.
3. It has also been resolved that the AGT may be processed on lines of existing policy in view of our submissions because it is already over delayed.
4. We hope that the administration will desist from rigid stand of imposing the changed policy, which is totally unacceptable to us at least for the time being and may need further deliberation for its various rectifications. If administration fails to appreciate our genuine grievance, we may resolve to chalk out further phases of steps to express our resentment in most effective and telling manner.
