Letter to CC, C.Ex., Ahmedabad regarding gross violation of transfer policy in AGT orders.

Sub :   Gross violation to the policy while issuing the Estt. Order No. 27/2014 & 28/2014, both dated 19th June, 2014 issued by the Commissioner, Central Excise, Rajkot : Matter regarding.

            Your kind attention is invited to the Estt. Order No. 27/2014 &  28/2014 both dated 19th June, 2014 issued by the Commissioner, Central Excise, Rajkot.

            Vide Estt. Order No. 27/2014, 19 Superintendents who are under order of posting to Rajkot Sector have been posted to Central Excise, Bhavnagar and 6 Superintendents have been posted to Rajkot Commissionerate. Further, 11 Superintendents have been transferred from Bhavnagar Commissionerate to Rajkot Commissionerate and 7 Superintendents have been transferred from Rajkot Commissionerate to Bhavnagar Commissionerate. Your attention is invited to Sr. No. 1 & 2 of the said order wherein two Superintendents belonging to Ahmedabad Sector have been posted to Rajkot Sector. This is in violation to the existing policy. Para 4 of the policy provides that all the Superintendents belonging to Ahmedabad Sector are to be posted to Bhavnagar Commissionerate only so far as there is deficiency at Bhavnagar Commissionerate. Thus, by posting these two Superintendents to Rajkot Commissionerate, the administration has grossly violated the policy provisions.

Further, vide above order, 20 Inspectors who got repatriated from Customs charge have been posted to Central Excise Commissionerate, Bhavnagar and against the same, 9 Inspectors have been transferred from Central Excise, Bhavnagar to Central Excise, Rajkot.

            In this connection, it is to submit that as per para 4(v) of  the policy, the tenure of Inspectors posted at Bhavnagar Commissionerate is 1 year. At present, Inspectors of Rajkot Commissionerate posted to Bhavnagar Commissionerate who are due for transfer to Rajkot Commissionerate in the AGT-2014 as per the policy. However, out of these Inspectors, only 9 Inspectors have been transferred to Rajkot Commissionerate and remaining are left out who were due for repatriation as per the policy. This is in total violation to the existing policy. The issue was also discussed with the previous Chief Commissioner 2 times during his visit to Rajkot and during our visit to Ahmedabad. At the material time, it was promised that all the officers who were working at Bhavnagar would be brought back to Rajkot during AGT-2014. However, the Committee of Commissioners comprising of the Commissioner, Central Excise, Rajkot and the Commissioner, Central Excise, Bhavnagar, while deciding the postings, grossly violated the policy provisions by not bringing back the Inspectors to their parent Commissionerate on completion of 1 year’s tenure at Bhavnagar Commissionerate.

            It is also to bring to your kind notice that the administration has never published the list of officers who are likely to be posted to Bhavnagar Commissionerate as provided under the policy and did not allow the affected officers to submit their representation. This is also gross violation to the principal of natural justice.

            The grievance was also submitted to the Commissioner, Central Excise Rajkot by the office bearers of both the Associations this evening. However the Commissioner could not explain any reason for violation to the policy and expressed his inability to make any amendment to the Orders in question.

In light of the above, it is requested to intervene into the matter and to direct the proper authority to amend the instant order and not to proceed with the AGT process until finalization of the issue.

            If the administration can not rectify the mistake committed by the Committee of Commissioners, we would be left with no other option to go for the agitation program and to take further course of action in order to get the rights which have been provided to us by virtue of law.

Minutes of the AGM held on 14.06.2014



MINUTES OF ANNUAL GENERAL MEETING OF ALL INDIA CENTRAL EXCISE INSPECTORS ASSOCIATION, RAJKOT BRANCH HELD AT RAJKOT ON 14.06.2014

At the inception, Hon'ble President of All India Central Excise Inspectors’ Association, Rajkot Branch warmly welcomed all the members of Inspector’s Association and declared open the meeting. Then after the proceedings begun as per the agenda of the meeting.

1.       The Secretary appraised the members about the recent developments regarding Cadre Restructuring and other issues taken up by the association at national level as well as local level.

2.       The accounts of the previous year were placed before the member in the house and the same was also were acceded to by all the members and passed unanimously.

3.       During the meeting it was discussed that at present the Association is not having full membership and there is a need to undertake massive membership drive. It was proposed that for effective functioning and to strengthen the association one post of Organization Secretary be created.

4.       Following this, the chief guest Shri G.K. Jhala, Secretary, Superintendents Association motivated the members towards achieving the individual goals as well as departmental goals and emphasized the need for effective contribution to the Association.

5.       Thereafter, the Secretary invited the resolutions / grievances from the members and following resolutions were passed unanimously.

a)       Strictly opposing the suo motu action of the administration by amending the policy fixing of tenure of posting to Bhavnagar as two years instead of one year as prevailing currently. Further it was resolved not to invite any change in the policy and whatever changes are to be made, the same would be made post implementation of the Cadre Review in consultation with the Associations.

b)       Creation of post of Organisation Secretary in order to strengthen the Association.

c)       Convening of quarterly meetings at all the Hq. offices viz. Rajkot, Bhavnagar and Jamnagar in order to effectively monitor the grievances and having better interaction with all the members posted at various formations.

d)       Periodic convening of JCMs at all the Commissionerates as per the various instructions and circulars issued by the Board.

6.       The house discussed in detail about the election of new body. All the members present in the house unanimously elected the following officers to act as the elected body for the Association of Rajkot Branch .

Meeting with the Committee of Executive Commissioners

Dear Members,

As posted on the blog dated 5th June, 2014, a meeting was held today with the committee of Executive Commissioners to decide whether to go ahead with the AGT-2014 or to wait for implementation of the Cadre Restructuring.

On behalf of Rajkot Sector, Superintendents Association as well as the undersigned emphasized for immediate ordering of the AGT on the ground that the officers who are due for repatriation from Customs  as well as Bhavnagar Central Excise Commissionerate are eagerly waiting for AGT orders. Moreover, the academic year has already begun and the officers who are due for transfer have sought admission of their children in various schools and have shifted their families in anticipation of the AGT-2014. It has already been delayed and till date, no one can predict when the Cadre Review would be implemented. Under these uncertainities, it is not at all desirable to postpone the AGT. Accordingly, we have submitted our written submission to the Committee and requested to issue the minutes of the meeting. The Committee accepted the requested and assured that the minutes would be issued.

Dear Members,

It is to bring to your notice that the Chief Commissioner, Central Excise, Ahmedabad, vide letter F.No.II/03-05/CCO/2014 dated 04-06-2014 have invited the officer bearers of this Association for a meeting on 10th June, 2014 in order to decide whether to carry on the AGT-2014 before the Cadre Restructuring or to wait till the implementation of the Cadre Restructuring.

In this connection, it is to inform that this Association and it’s members are of the firm opinion that the AGT-2014 has already been delayed and it should not be delayed further in anticipation of Cadre Restructuring. Till date, the notification with regard to allocation of posts and creation of new Comissionerates has not been issued and it is likely to take some more time. We should not wait for implementation of the CR in order to effect the AGT-2014.

Accordingly, this Association as well as Supereintendent’s Association have already conveyed our feelings to the Chief Commissioners. Again during the course of the meeting to be held on 10th June, we shall reiterate our demand for immediate ordering of AGT-2014 orders and the procedure of AGT-2014 may be completed by 20th June, 2014.

Letter to Commissioner, C.Ex., Bhavnagar regarding JCM

It is to bring to your notice that All India Central Excise Inspectors’ Association, Rajkot Branch represents the Inspectors  of Central Excise Rajkot, Bhavnagar and Customs(Prev) Jamnagar Commissionerates.

It has been brought to the notice of the association by the members of Bhavnagar Commissionerate that a circular dated 26.05.2014 intimating the staff associations regarding schedule of J.C.M. of Bhavnagar Commissionerate on  27.05.2014 was issued. 

None of the office bearers of this Association is currently posted at Bhavnagar. Moreover the jurisdiction of Bhavnagar Central Excise Commissionerate is spread over the distance of more than 200 Kms. Under these circumstances, it was not possible for us to collect the grievances from the field formations and to represent the same before your goodself.

As per the existing instructions issued by C.B.E.C periodic JCMs are to be mandatorily held in order to address the grievances of the staff members. However, we were given almost no time to collect and represent the grievances to your goodself.  It is therefore requested to kindly re-fix the JCM and intimate the date of JCM to this Association well in advance so that the grievances of the staff members can be represented in an effective manner.
