Letter to CC, C.Ex., Ahmedabad regarding gross violation of transfer policy in AGT orders.

::  ALL INDIA ASSOCIATION OF CENTRAL EXCISE & CUSTOMS GAZETTED EXECUTIVE OFFICERS ::
::RAJKOT BRANCH ::

::  ALL INDIA CENTRAL EXCISE INSPECTORS ASSOCIATION  ::
:: RAJKOT BRANCH ::

Date :  19th June, 2014.
To,
The Chief Commissioner,
Central Excise, Ahmedabad Zone,
Ahmedabad.

Respected sir,

Sub :   Gross violation to the policy while issuing the Estt. Order No. 27/2014 & 28/2014, both dated 19th June, 2014 issued by the Commissioner, Central Excise, Rajkot : Matter regarding.

Your kind attention is invited to the Estt. Order No. 27/2014 &  28/2014 both dated 19th June, 2014 issued by the Commissioner, Central Excise, Rajkot.

Vide Estt. Order No. 27/2014, 19 Superintendents who are under order of posting to Rajkot Sector have been posted to Central Excise, Bhavnagar and 6 Superintendents have been posted to Rajkot Commissionerate. Further, 11 Superintendents have been transferred from Bhavnagar Commissionerate to Rajkot Commissionerate and 7 Superintendents have been transferred from Rajkot Commissionerate to Bhavnagar Commissionerate. Your attention is invited to Sr. No. 1 & 2 of the said order wherein two Superintendents belonging to Ahmedabad Sector have been posted to Rajkot Sector. This is in violation to the existing policy. Para 4 of the policy provides that all the Superintendents belonging to Ahmedabad Sector are to be posted to Bhavnagar Commissionerate only so far as there is deficiency at Bhavnagar Commissionerate. Thus, by posting these two Superintendents to Rajkot Commissionerate, the administration has grossly violated the policy provisions.

Further, vide above order, 20 Inspectors who got repatriated from Customs charge have been posted to Central Excise Commissionerate, Bhavnagar and against the same, 9 Inspectors have been transferred from Central Excise, Bhavnagar to Central Excise, Rajkot.

In this connection, it is to submit that as per para 4(v) of  the policy, the tenure of Inspectors posted at Bhavnagar Commissionerate is 1 year. At present, Inspectors of Rajkot Commissionerate posted to Bhavnagar Commissionerate who are due for transfer to Rajkot Commissionerate in the AGT-2014 as per the policy. However, out of these Inspectors, only 9 Inspectors have been transferred to Rajkot Commissionerate and remaining are left out who were due for repatriation as per the policy. This is in total violation to the existing policy. The issue was also discussed with the previous Chief Commissioner 2 times during his visit to Rajkot and during our visit to Ahmedabad. At the material time, it was promised that all the officers who were working at Bhavnagar would be brought back to Rajkot during AGT-2014. However, the Committee of Commissioners comprising of the Commissioner, Central Excise, Rajkot and the Commissioner, Central Excise, Bhavnagar, while deciding the postings, grossly violated the policy provisions by not bringing back the Inspectors to their parent Commissionerate on completion of 1 year’s tenure at Bhavnagar Commissionerate.

It is also to bring to your kind notice that the administration has never published the list of officers who are likely to be posted to Bhavnagar Commissionerate as provided under the policy and did not allow the affected officers to submit their representation. This is also gross violation to the principal of natural justice.

The grievance was also submitted to the Commissioner, Central Excise Rajkot by the office bearers of both the Associations this evening. However the Commissioner could not explain any reason for violation to the policy and expressed his inability to make any amendment to the Orders in question.

In light of the above, it is requested to intervene into the matter and to direct the proper authority to amend the instant order and not to proceed with the AGT process until finalization of the issue.

If the administration can not rectify the mistake committed by the Committee of Commissioners, we would be left with no other option to go for the agitation program and to take further course of action in order to get the rights which have been provided to us by virtue of law.

Yours faithfully,

Meeting with the Committee of Executive Commissioners

Dear Members,

As posted on the blog dated 5th June, 2014, a meeting was held today with the committee of Executive Commissioners to decide whether to go ahead with the AGT-2014 or to wait for implementation of the Cadre Restructuring.

On behalf of Rajkot Sector, Superintendents Association as well as the undersigned emphasized for immediate ordering of the AGT on the ground that the officers who are due for repatriation from Customs  as well as Bhavnagar Central Excise Commissionerate are eagerly waiting for AGT orders. Moreover, the academic year has already begun and the officers who are due for transfer have sought admission of their children in various schools and have shifted their families in anticipation of the AGT-2014. It has already been delayed and till date, no one can predict when the Cadre Review would be implemented. Under these uncertainities, it is not at all desirable to postpone the AGT. Accordingly, we have submitted our written submission to the Committee and requested to issue the minutes of the meeting. The Committee accepted the requested and assured that the minutes would be issued.

Dear Members,

It is to bring to your notice that the Chief Commissioner, Central Excise, Ahmedabad, vide letter F.No.II/03-05/CCO/2014 dated 04-06-2014 have invited the officer bearers of this Association for a meeting on 10th June, 2014 in order to decide whether to carry on the AGT-2014 before the Cadre Restructuring or to wait till the implementation of the Cadre Restructuring.

In this connection, it is to inform that this Association and it’s members are of the firm opinion that the AGT-2014 has already been delayed and it should not be delayed further in anticipation of Cadre Restructuring. We should not wait for implementation of the CR in order to effect the AGT-2014.

Accordingly, this Association as well as Supereintendent’s Association have already conveyed our feelings to the Chief Commissioners. Again during the course of the meeting to be held on 10th June, we shall reiterate our demand for immediate ordering of AGT-2014 orders and the procedure of AGT-2014 may be completed by 20th June, 2014.

Letter to Commissioner, C.Ex., Bhavnagar regarding JCM

29.05.2014
To
The Commissioner,
Central Excise,
Bhavnagar.

Sir,

Sub:   JCM Held at Bhavnagar on 27.05.2014: m/r.
*****

It is to bring to your notice that All India Central Excise Inspectors’ Association, Rajkot Branch represents the Inspectors  of Central Excise Rajkot, Bhavnagar and Customs(Prev) Jamnagar Commissionerates.

It has been brought to the notice of the association by the members of Bhavnagar Commissionerate that a circular dated 26.05.2014 intimating the staff associations regarding schedule of J.C.M. of Bhavnagar Commissionerate on  27.05.2014 was issued.

None of the office bearers of this Association is currently posted at Bhavnagar. Moreover the jurisdiction of Bhavnagar Central Excise Commissionerate is spread over the distance of more than 200 Kms. Under these circumstances, it was not possible for us to collect the grievances from the field formations and to represent the same before your goodself.

As per the existing instructions issued by C.B.E.C periodic JCMs are to be mandatorily held in order to address the grievances of the staff members. However, we were given almost no time to collect and represent the grievances to your goodself.  It is therefore requested to kindly re-fix the JCM and intimate the date of JCM to this Association well in advance so that the grievances of the staff members can be represented in an effective manner.

Thanking you in anticipation,

Yours faithfully,

Letter to CC, C.Ex., Ahmedabad requesting for issuance of AGT-2014 order.

ALL INDIA CENTRAL EXCISE INSPECTORS’ ASSOCIATION, RAJKOT BRANCH

F.No. AICEIA/RJT/1/2008                                               Date: 26.05.2014

To,
The Chief Commissioner,
Central Excise Ahmedabad Zone,
Ahmedabad.

Sir,

Sub:   Issuance of AGT 2014 orders - reg.

Sir, as your honour is already aware that the AGT 2014 orders were not issued as it was expected that the Cadre restructuring in CBEC is likely to be implemented in the month of May. The messages issued by the Chairman CBEC also informed that the notifications are expected to be issued by 23.05.2014. However the notifications are not issued and on other hand some order issued by the CBEC are also kept on hold. This gives an impression that the Cadre Restructuring process will be delayed.

Sir, Rajkot Sector comprises of three Commissionerates i.e. Central Excise Commissionerate Rajkot & Bhavnagar and Customs Preventive Commissionerate Jamnagar. The jurisdiction overseen by these Commissionerates is entire Saurashtra region. The distance from one end to other end of this region is more than 500 kms. And top of it, it boasts of very hostile and far-flung areas and vast coastline at inhospitable places where the Customs and Central Excise office are found dotted.

We are now in the last week of May and it is about time by which ideally the Annual General Transfer exercise should be over. During AGT inter-exchange or intra-exchange of the officers from one Commissionerate to another or within Commissionerate takes place. Owing to vastness of this jurisdiction, often the officers are required to shift their family and domicile, leaving little time to cope up with the situation. Shifting family and domicile accompanies with it many arduous hardship and tasks, which are not quite facile to manage. Admission for their kids/wards at a school/college, finding appropriate accommodation, getting utilities connections at a new place of posting, far away from their present posting, are some of the difficulties that stares at the officer in such event.   Under the given circumstances timely issuance of AGT orders assumes great importance and provides much needed succor to the officers.

Sir, the members of this Association are quite worried and anxious on this count and therefore we urge your kind honour to issue suitable directions to the Committee to issue the AGT orders for 2014 immediately and at least orders transferring officers to / from Customs by 31st May.

Furthermore, it is sincerely requested that as the annual general transfer orders are already over delayed leading to undue hardship to the officers affected, it is once again requested to issue the AGT-2014 orders as early as possible.

Thanking you in anticipation,

Yours faithfully,

(Dilip J. Pandya)

Letter to CC, C.Ex. Ahmedabad reg. formulation of Transfer Policy.

::  ALL INDIA CENTRAL EXCISE INSPECTORS ASSOCIATION  ::
RAJKOT BRANCH  :

Date : 2nd May, 2014.
To
The Chief Commissioner,
Central Excise,
Ahmadabad Zone

Sir,

Sub :  Formulation of transfer policy with respect to annual general transfer in the grade of inspectorsreg.

Kindly refer to letter F. No. II/03-01/CCO/2013 dt. 17.04.2014 issued by Additional Commissioner (P&V), CCO, Central Excise, Ahmedabad requesting the associations to apprise their views to the committee on the issue of transfer.

At the outset, we oppose any move to amend the existing policy which has been running smoothly. Instead of amending the policy, we recommend that the existing policy gets implemented in toto. In past also, we have repeatedly requested the administration to adhere the policy and also went for agitation programme when the administration grossly violated the existing policy. However, since we are called to offer our views, the same are mentioned hereunder ;

1.               Regarding categorization of each station and fixing of tenure, it is submitted that the tenure for each formation is already fixed under the existing policy. Only names of the station are to be categorized as Class A, B or C. However, the problem is that due to geographical position of Rajkot Commissionerate and considering the other policy parameters (i.e. Customs / Bhavnagar etc.), none of the officer is able to complete the station tenure as prescribed in the policy.

2.               Under the said letter, it is alleged that the staff once posted at Ahmedabad Sector and Rajkot Commissionerate does not want to move out of their stations and the staff posted at Bhavnagar get stuck there for longer periods / permanently. This allegation seems to be totally baseless so far as it relates to Rajkot Commissionerate as majority of the Inspectors  have to get transferred to either Customs or Bhavnagar prior to completion of their tenure at Rajkot.  It is also to submit that the jurisdiction of Rajkot Commissionerate is not confined to Rajkot city only but it is scattered the distance from one corner of the Commissionerate to the another one is approximately 300 kms. Moreover, we are also to perform our duties under the Customs charge (where none of the formations is located at Rajkot) and therefore no officer can stick to Rajkot city as alleged in the letter. Further, it is mentioned that the officers are stuck up at Bhavnagar Commissionerate. To the best of our knowledge, there is not a single transfer application pending with the administration wherein any officer who has completed 4 years has sought transfer to Rajkot Commissionerate. In contradiction to this, various orders issued by your good office would reveal that during last 2 years as many as 23 Inspectors have been transferred either to Ahmedabad or to other Commissionerates (i.e. inter Commissionerate transfer to other zones). Thus, the allegations mentioned in the letter are far from the truth.

3.               Over the years, the officers of Rajkot Commissionerate are filling up the vacancies of Bhavnagar Commissionerate resulting into disturbance in the education of their children, bearing the cost of double establishment etc. Adding fuel to the issue, Central Excise Commmissionerate, Gandhidham is likely to come into existence post cadre restructuring. Under these circumstances, we cannot bear any more displacement just for the cause of others. If at all any officer wishes to be transferred to Rajkot Commissionerate, he can only be accommodated against either fresh recruitee or fresh promotee officer as and when such situation arises.

4.               The said letter says that the officers of Bhavnagar Commissionerate may be posted to Rajkot/Ahmedabad on his “request”. If casual request of the officers is to be incorporated in the policy, then many other “request” from other Commissionerate must also be incorporated in the policy. Anyway, if the request is to be considered no substitute will be provided from Rajkot Commissionerate.

5.               It is observed that frequent changes in the transfer policy are made every time at the time of Annual general transfer which is unwanted and undesired. This is nothing but the harassment being felt by the members, who are the hands of the department.

6.               Last but not the least, it is very humbly submitted that before making any amendment to the existing policy, the administration must specify a specific tenure for Rajkot station as well as Rajkot Commissionerate prior to which no officer is transferred to any other place outside Rajkot / Jamnagar / Gandhidham station under any policy.

7.               Lastly it is requested to provide an opportunity to this Association to be heard in person before implementing any amendment to the existing policy.

                                                                          Yours faithfully,

(D.J.PANDYA)
