Sub: Posting of new recruit inspector to Bhavnagar Commissionerate.

Sir, as your honour is already aware that Rajkot Sector comprises of three Commissionerates i.e. Central Excise Commissionerate Rajkot & Bhavnagar and Customs Preventive Commissionerate Jamnagar. The jurisdiction overseen by these commissionerates is entire Saurashtra region. The distance from one end to other end of this region is more than 500 kms. And top of it, it boasts of very hostile and far-flung areas and vast coastline at inhospitable places where the Customs and Central Excise office are found dotted.


Sir, your kind attention is invited to the present position of officers of Rajkot Commissionerate posted to Bhavnagar Commissionerate. During the restructuring of jurisdiction, bifurcation of the Rajkot Commissionerate which was carried out in the year 2001-02, two Central Excise Commissionerates viz. Bhavnagar and Rajkot came into existence. Due to carving of new Bhavnagar Commissionerate, there occurred an inevitable staffing imbalance and an consensus was arrived at, at the relevant time that the deficiency in the ministerial staff in respect of Bhavnagar Commissionerate would be filled by the Rajkot Commissionerate and the deficiency in the executive cadre would be would be filled up by Ahmedabad Sector and accordingly the orders were issued. This practice was discontinued from the year 2004-05 onwards and only the Inspectors of Rajkot Commissionerate are being posted to Bhavnagar Commissionerate. These officers posted to Bhavnagar Commissionerate are to be repatriated as per the transfer policy.


During the annual general transfer order issued in May-2009 and June 2010 some officers of Rajkot Commissionerate were posted to Bhavnagar Commissionerate. Only few of these officers were repatriated to their parent Commissionerate as per the transfer policy. These officers have also given representations but administration has not considered their grounds as genuine and did not consider their requests. Further at the time of the annual general transfer order issued in May-2009 and June-2010 some of the officers whose parent Commissionerate is Rajkot Commissionerate, on repatriation from Customs Preventive Commissionerate Jamnagar were posted to Bhavnagar Commissionerate.


At present we do not have specific cadre of Custom officers. The Central Excise officers of Rajkot Commissionerate and Bhavnagar Commissionerate are sent on transfer basis to man Customs formation. After completion of their tenure of 4years in Customs Preventive Commissionerate Jamnagar the officers are to be repatriated to their respective parent Commissionerate. However from the annual general transfer order issued in May -2009, the officers of Rajkot Commissionerate (their parent Commissionerate) after completion of their tenure in Customs Preventive Commissionerate Jamnagar are being transferred to Central Excise Commissionerate Bhavnagar to fill deficiency/ vacancy. In this way in all they have completed more than around 5 years and more than 5 years of tenure out of their parent Commissionerate.


Keeping in view the above position of the existing transfer policy, this Association begs to submit the following few lines for your kind consideration:


Your kind attention is invited to the Transfer Policy for Rajkot Sector framed by the Hon’ble Chief Commissioner, Central Excise, Ahmedabad vide his office letter F.No. II/3-11/CCO/2002 Pt.-I dated 13.05.2009 wherein at para 4 the manner of posting officers to Bhavnagar Commissionerate in case of deficiency/vacancy in the number of officer in Bhavnagar Commissionerate, is mentioned. At para 4 (ii) it is mentioned that newly recruited officers shall be posted at Bhavnagar Commissionerate.


The Additional Commissioner (P&V), Central Excise & Customs, Vadodara-I has vide Establishment Order No. 141/2010 dated 15.11.2010 allotted 115 newly recruited Inspectors to Ahmedabad Zone. The association would like to suggest that in light of para 4 (ii) of the existing transfer policy the newly recruited Inspectors may be posted to Central Excise Commissionerate, Bhavnagar and the officers of Rajkot Commissionerate presently posted to Bhavnagar Commissionerate may be transferred to Rajkot Commissionerate i.e. their parent Commissionerate. Posting of such newly recruited officers would help to have a permanent strength of Inspectors in Bhavnagar Commissionerate. The office bearers had held discussion with your honour on 02.12.2010 at Rajkot regarding the posting of newly recruited Inspectors to Central Excise Commissionerate, Bhavnagar in substitute against the officers who may be transferred from Bhavnagar Commissionerate to Rajkot Commissionerate and your honour had told the association to look in to the matter positively. It is requested to consider the above request favorably, as this would result in creating permanent strength of Inspectors at Bhavnagar Central Excise Commissionerate and bringing a permanent solution of providing staff from of Rajkot Commissionerate.


In view of the above, it is humbly requested to consider the above request and issue suitable instructions in the matter to the concerned resulting in a permanent solution. It is once again sincerely requested to consider the above request.

With reference to the subject matter, the situation prevailing at Customs (Prev) Commissionerate Jamnagar has compelled this association to make this representation for your kind consideration.


It has been brought to the notice of the association that the circular calling willingness for deputations to other organizations/ agencies are not being circulated amongst the officers of Customs (Prev), Commissionerate Jamnagar. Further at present letter calling willingness for deputation of Inspectors for posting to Custom Commissionerate, Kandla by Additional Commissioner (P&V), Central Excise & Customs, Vadodara vide letter F.No.II/13-02/2010-Estt. dated 21.10.2010 is not being circulated amongst the officers of Customs (Prev), Commissionerate Jamnagar.


At present there is no separate specific cadre of Custom officers. If the willingness for deputation submitted by the officers of Customs (Prev), Commissionerate Jamnagar are not forwarded to the concerned organizations/agencies it would deprive the officers from the exposure of different kind of work. Hence, in the interest of justice and equality, it would be fair that the officers desirous for submitting willingness for deputation postings and work with Custom Commissionerate, Kandla and other organizations/ agencies may not be deprived from such prerogative.


The association had already requested the administration vide letter dated 02.11.2010 and reminder dated 08.11.2010 to kindly circulate the circulars calling for willingness for deputation to various agencies and also forward the willingness submitted by the officers to the concerned organizations/ agencies, but till date the request has not been considered nor the administration has not communicated any reason for not circulating the circulars calling willingness.


In view of the above, it is humbly requested to intervene in the matter and issue suitable instructions for circulating the circulars calling for willingness for deputation to Custom Commissionerate, Kandla and other organizations/ agencies and forwarding the willingness submitted by the officers to the concerned organizations/ agencies. It is once again sincerely requested to consider the above request.

Sub: Allowing resumption of Inspectors promoted to the Grade of Superintendent at their respective Commissionerate.

With reference to the subject matter, the situation prevailing at Rajkot, Bhavnagar and Customs (Prev) Commissionerate Jamnagar has compelled this association to make this representation for your kind consideration.

Recently 21 inspectors + 2 inspectors have been promoted from the grade of Inspector to the grade of Superintendent Group B vide Establishment Order No. 40/2010 dated 29.10.2010 issued by the Chief Commissioner, Central Excise, Customs and Service Tax, Vadodara,.

Due to administrative exigencies for issuing detailed order of sector/Commissionerate, there is time gap of 25 to 30 days. However, normally the promoted officers are provided with the period of 15 days, within which they are supposed join/accept their promotion order. At the time of issuing promotion order, the officers are placed at the disposal of Ahmedabad Zonal office. During this intervening period, officers promoted from other than Commissionerates of Ahmedabad Sector, are placed in very peculiar situation. Since the Sector orders are not issued, sectoral cadre controlling authority at Rajkot is not in position to accept the resumption/acceptance report from the promoted officers. Therefore, for few days, till the sector orders are issued, the officers from Kandla, Rajkot, Bhavnagar and Customs (Prev) Commissionerate Jamnagar are compelled to join the zonal establishment office at Ahmedabad. This Association is of opinion and request your honour to issue suitable instructions to the sectoral cadre controlling authority at Rajkot, to accept resumption report of the officers promoted at their respective Commissionerate where they are presently posted, just as was system prevailing in the erstwhile period. This would spare the promoted officers from avoidable hardship they have to undergo at the time promotion, dampening the spirit of joy which has come to them after a long wait of almost 17/18 years. Joining at Ahmedabad would further entail the officer to get relieved from Kandla/ Bhavnagar/ Jamnagar/ Rajkot, join at Ahmedabad, again getting relieved from Ahmedabad, joining at Rajkot Sector, and again joining to the Commissionerate, where they are eventually posted.

Prayer: To issue suitable instructions to the Sectoral Cadre Controlling Authority, Rajkot so that they are able to accept resumption/acceptance report from the officers promoted from the grade of Inspector to the grade of Superintendent at their respective Commissionerate.

Sub: Filling up of vacancies occurred in sensitive places in the grade of Inspector due to promotion to the grade to Superintendent.

With due respect, this \association would like to submit following few lines for your kind consideration please.

Sir, recently promotion orders in the grade of Inspectors to Superintendent were issued by the Cadre Controlling Authority in Gujarat Zone. Some of the Inspectors working in Customs Commissionerate Jamnagar were also promoted to the grade of Superintendent and hence some vacancies have occurred due to above promotion orders. These vacancies mainly occurred in the sensitive postings.

This Association would like to request that if the administration is planning to fill these vacancies arose on account of promotion orders, than the order may please be issued as per the existing transfer / rotation policy. Officers who have been transferred to the sensitive charges / place vide last AGT order may not be disturbed with regard to change of station unless one is willing for the same, as these officers have already worked at these sensitive postings last four months and are well familiar and acquainted with the complicated custom procedure and work. Officers who have joined customs Commissionerate Jamnagar last year and are about to complete one year period of non-sensitive charge within short time may be considered for posting of sensitive post.

It is sincerely requested to consider the above request and issue the orders as per the transfer/ rotation policy.

Annual General Meeting of Rajkot Branch

A meeting of members of All India Central Excise Inspectors’ Association, Rajkot Branch was held on 21.08.2010 at Rajkot.

In the meeting, the members were briefed about the discussions held and decisions taken in the CEC meeting of All India Central Excise Inspectors’ Association held on 31.07.2010 & 01.08.2010 at Indore.

Decision was also taken to convene the Annual General Meeting of All India Central Excise Inspectors’ Association, Rajkot Branch. Accordingly, it has been decided to convene the Annual General Meeting of Rajkot Branch on 18.09.2010 Saturday at Rajkot.

All the members are requested to make it convenient to attend the AGM without fail to make it grand success.

Detailed schedule will be conveyed in due course.

Letter to CC, C.Ex., Ahmdabad reg. grievances in AGT orders

The annual general transfer orders in the grade of Inspectors (Inter Commissionerate Transfers) of Rajkot Sector have been issued by Chief Commissioner Office on 24.05.2010. There is a feeling of distress and disappointment amongst the members of the association as the policy framed by the Chief Commissioner office has not been followed by the administration in some cases. Hence this association would like to put up following points/ grievances for your kind consideration.

These officers have completed 2 years of tenure in Bhavnagar Commissionerate. However these officers were not repatriated to their parent Commissionerate as per the transfer policy. These officers have also given representations but administration has not considered their grounds as genuine and did not consider their requests.


At the time of the annual general transfer order issued in May-2009, 11 officers whose parent Commissionerate is Rajkot Commissionerate, on repatriation from Customs Preventive Commissionerate Jamnagar were posted to Bhavnagar Commissionerate. All these officers are due for repatriation to their parent Commissionerate but they have not been transferred to Rajkot Commissionerate in this AGT.

In all they have completed 5 years of tenure out of their parent Commissionerate.


It is sincerely requested to consider the above request and issue suitable orders for the transfer of the above officers to their parent Commissionerate taking into consideration the guidelines framed under transfer policy particularly in respect of offices posted to Bhavnagar Commissionerate. Sir, the members of this Association would be greatly indebted to your Honour if the above concerns are looked in to favorably.

Letter to the Commissioner, CCE, Rajkot regarding AGT

Sir, as your honour is already aware that Rajkot Sector comprises of three Commissionerates i.e. Central Excise Commissionerate Rajkot & Bhavnagar and Customs Preventive Commissionerate Jamnagar. The jurisdiction overseen by these commissionerates is entire Saurashtra region. The distance from one end to other end of this region is more than 500 kms. And top of it, it boasts of very hostile and far-flung areas and vast coastline at inhospitable places where the Customs and Central Excise office are found dotted.


We are now in the third week of April month and it is about time by which ideally the Annual General Transfer exercise should be over. During AGT inter-exchange or intra-exchange of the officers from one Commissionerate to another or within Commissionerate takes place. Owing to vastness of this jurisdiction, often the officers are required to shift their family and domicile, leaving little time to cope up with the situation. Shifting family and domicile accompanies with it many arduous hardship and tasks, which are not quite facile to manage. Admission for their kids/wards at a school/college, finding appropriate accommodation, getting utilities connections at a new place of posting, far away from their present posting, are some of the difficulties that stares at the officer in such event. Under the given circumstances timely issuance of AGT orders assumes great importance and provides much needed succor to the officers. In the Rajkot Sector, Rajkot Commissionerate occupies centrality in the entire AGT process that is to mean that AGT process can only be started in the other commissionerates, i.e. Jamnagar and Bhavnagar Commissionerates, only after the AGT orders by the Rajkot Commissionerate are issued.


Normally, after issuance of orders by the Rajkot Commissionerates, the other two commissionerates, also take 2/3 weeks to wrap up the AGT process. In some of the cases, this involves a three/four tier shuffling of the officers. Say for example, an officer placed at disposal of Customs, Jamangar or C. Excise, Bhavnagar Commissioner has to wait for further two orders before his ultimate place of posting is decided.


Sir, the members of this Association are quite worried and anxious on this count and therefore we urge your kind honour to issue the AGT orders for 2010 as soon as possible.


Sir, your kind attention is also invited to the present position of officers of Rajkot Commissionerate posted to Bhavnagar Commissionerate. During the restructuring of jurisdiction, bifurcation of the Rajkot Commissionerate which was carried out in the year 2001-02, two Central Excise Commissionerates viz. Bhavnagar and Rajkot came into existence. Due to carving of new Bhavnagar Commissionerate, there occurred an inevitable staffing imbalance and an consensus was arrived at, at the relevant time that the deficiency in the ministerial staff in respect of Bhavnagar Commissionerate would be filled by the Rajkot Commissionerate and the deficiency in the executive cadre would be would be filled up by Ahmedabad Sector and accordingly the orders were issued.


This practice was discontinued from the year 2004-05 onwards and only the Inspectors of Rajkot Commissionerate are being posted to Bhavnagar Commissionerate. At present officers of Rajkot Commissionerate are posted to Bhavnagar Commissionerate. These officers were posted to Bhavnagar Commissionerate during:-


(a) the general rotation order issued in June-2008 , which also include the officers promoted from ministerial cadre to executive cadre in May-2008.


(b) the general rotation order issued in May-2009, which also include the officers of Rajkot Commissionerate, on repatriation from Customs Preventive Commissionerate Jamnagar were posted to Bhavnagar Commissionerate.


Some of the officers from above had submitted their representations on various grounds for their repatriation to Rajkot Commissionerate. Out of which only few have been considered, however most of the officers are still waiting for their repatriation back to Rajkot Commissionerate. Meanwhile new recruited officers were also posted in all the three Commissionerates and as per the policy there was an opportunity to appoint/post these fresh officers to Bhavnagar Commissionerate, which would have resulted in creating permanent staff of Bhavnagar Commissionerate and repatriation of officers of Rajkot Commissionerate therefrom, but unfortunately this was not availed. In view of above, the association would like to represent before your honour that the officers of Rajkot Central Excise Commissionerate presently posted at Bhavnagar Central Excise Commissionerate should be repatriated in the AGT-2010, without further injustice.


In addition to above, this association would like to put up following suggestions for your kind consideration:-


(1) The administrative control of issuing of transfer/ rotation/posting order shall vest with the Commissioner i.e. the orders of postings in Range offices must also be done by the Commissioner himself as the Central Excise Division offices are not having the history of posting of the officers posted in their divisions.


(2) The sensitive and Non sensitive posting shall be identified and same may be notified.


(3) Officers should not be posted repetitively to the same and/or sensitive/ non-sensitive postings.


(4) If sufficient number of willing officers is available from Central Excise formation, the request of any officer for retention in Customs shall not be entertained.


(5) While posting officers to sensitive postings in Custom Divisions, proportionate posting of both senior and junior officers shall be done.


(6) Time period/ tenure/ cut off date for transfer and posting should be counted from AGT to AGT, if the officer has been transferred during the course of AGT, irrespective of the fact that the officer has joined/ relieved after a gap of couple of month after issuance of AGT orders.


(7) It is observed that the officers are not relieved even after the order of transfer/ rotation is issued. All the officers transferred/ rotated shall invariably be relieved on or before stipulated date.


Furthermore, it is sincerely requested to consider the above suggestions/ points in the ensuing AGT. The annual general transfer orders are already over delayed which lead to undue hardship to the officers affected, Hence it is once again requested to issue the AGT orders as early as possible.

Earlier the willingness were being forwarded directly to such organizations/ agencies calling willingness

Sir, you are aware that the posting of Inspectors to other agencies such as DRI, SEZ, DGCEI, Custom House Kandla etc. are done on deputation basis. The primary objective of deputation postings is to expose the officers to different kind of work. The willingness for deputation to other organizations/ agencies are being forwarded by other Comissionerates of Rajkot Sector and also other Commissionerate outside Rajkot Sector directly to the organizations/agencies calling willlingness. If the willingness for deputation submitted by the officers of Customs Commissionerate Jamnagar are not forwarded to the concerned organizations/agencies in time it would deprive the officers from the exposure of different kind of work. Hence, in the interest of justice and equality, it would be fair that the officers desirous for submitting willingness for deputation postings and work with other organizations/agencies may not be deprived from such prerogative.

CIRCULAR

CIRCULAR
A meeting of the members of All India Central Excise Inspectors’ Association, Rajkot Branch is being convened at 10:00 AM on 30.01.2010 Saturday at below mentioned address :

The main agenda of the meeting is as under :
  1. To discuss the issue of proposal for creation of separate Customs Zone Cadre in Gujarat.
  2. To brief the discussion held and decisions taken in the All India Central Excise Inspectors’ Association CEC meeting held at Jaipur on 23.01.2010 & 24.01.2010. The meeting was attended by the Secretary and the President of All India Central Excise Inspectors’ Association, Rajkot Branch.
  3. Any other issue the members would like to discuss and pass resolution.

CEC Meeting held at Jaipur


The 2nd Central Executive Committee (CEC) meeting was held on 23rd and 24th January, 2010 at Jaipur (Rajasthan) by the Rajasthan Circle of AICEIA. Shri Uttam R. Bhalsod, President and Shri Dilip J. Pandya, Secretary of Rajkot Branch attended the meeting.

The open session of the meeting was inaugurated by Shri R.K.Singh, Commissioner of Central Excise, Jaipur-II.

Mainly following issues along with other issues were discussed in the closed session :

  • Restoration of grade pay of Inspectors to Rs. 4600/- and fixation of pay on promotion or by direct recruit who have joined before 01.01.2006.
  • Removal of stagnation.
  • Modification in the Constitution of AICEIA.
  • Cadre Restructuring.

Three new units i.e. Nasik joined the Association right before the CEC and Indore & Bhopal joined the Association in the CEC.

The CEC decided to opt for joint movement with the other counterparts in the revenue department and also to form a Joint Action Committee along with the Superintendent Association in our department. Action programme on the pending issues shall be decided in consultation with the Superintendent Association.
